Terms and Conditions

These terms explain the rules for using PulseCheck and the responsibilities that come with creating monitors, receiving alerts, and managing a paid or free account.

1. Agreement to These Terms

These Terms and Conditions govern your access to and use of PulseCheck, including our website, uptime monitoring tools, alerting features, dashboards, billing flows, and related services. By creating an account, using the service, or continuing to access PulseCheck, you agree to these terms.

If you use PulseCheck on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the service.

2. The Service

PulseCheck provides website and service monitoring tools, including uptime checks, response-time tracking, error detection, SSL certificate and domain expiry monitoring, diagnostics, and email or Slack alerts. The service is designed to help you notice problems quickly, but it is not a guarantee that every outage, error, delay, security issue, or expiry event will be detected or reported.

We may change, improve, suspend, or discontinue parts of the service from time to time. We will try to avoid unnecessary disruption, especially for paid features, but we cannot promise that every feature will remain available forever.

3. Accounts and Security

You are responsible for the information you provide when creating an account and for keeping your login credentials secure. You must notify us if you believe your account has been accessed without permission.

You are responsible for all activity under your account, including monitors, alert destinations, billing changes, and integrations configured by you or anyone you authorize.

4. Acceptable Use

You agree not to use PulseCheck to:

  • Monitor, probe, or collect information from systems you do not own or have permission to monitor.
  • Interfere with, overload, disrupt, or attempt to gain unauthorized access to PulseCheck or any third-party service.
  • Send unlawful, abusive, deceptive, harassing, or unwanted notifications.
  • Reverse engineer, scrape, copy, or misuse the service except as allowed by law.
  • Use PulseCheck in a way that violates applicable laws, third-party rights, or platform rules for connected services such as Slack.

We may suspend or terminate accounts that we reasonably believe violate these terms, create risk for the service, or harm other users or third parties.

5. Monitors, Alerts, and Customer Content

You retain ownership of the URLs, configuration, alert settings, labels, and other content you submit to PulseCheck. You grant us permission to use that content as needed to provide, secure, troubleshoot, and improve the service.

Alerts may be delayed, filtered, fail to deliver, or contain incomplete information because of network conditions, third-party provider issues, rate limits, incorrect settings, or other factors outside our control. You should not rely on PulseCheck as your only safeguard for critical systems.

6. Plans, Billing, and Cancellation

PulseCheck may offer free and paid plans. Paid subscriptions are billed in advance through our payment processor, Stripe, according to the plan and billing interval you select at checkout. Prices, limits, and included features are shown on the site or in the checkout flow.

You may cancel a paid subscription through the billing portal or by contacting us. Unless stated otherwise at checkout, cancellation stops future renewals but does not automatically refund amounts already paid. We may change pricing or plan limits with notice when required by law or by payment platform rules.

7. Third-Party Services

PulseCheck relies on third-party services for hosting, authentication, payments, email delivery, analytics, diagnostics, alerting, integrations, and other infrastructure. Your use of those features may be subject to the third party's own terms and privacy practices.

We are not responsible for third-party services, outages, data handling, pricing changes, or integration behavior outside our reasonable control.

8. Intellectual Property

PulseCheck, including its software, design, branding, website copy, workflows, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These terms do not transfer ownership of PulseCheck to you.

You may use the service only as permitted by these terms. You may not copy, resell, sublicense, or exploit the service except with our written permission.

9. Disclaimers

PulseCheck is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not guarantee that PulseCheck will detect every incident, preserve every piece of data, or meet every compliance, operational, or security requirement for your business.

10. Limitation of Liability

To the fullest extent permitted by law, PulseCheck and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, downtime, business interruption, or loss of goodwill.

To the fullest extent permitted by law, our total liability for any claim related to the service will not exceed the amount you paid to PulseCheck for the service in the three months before the event giving rise to the claim, or $100 if you have not paid us.

11. Indemnification

You agree to defend, indemnify, and hold harmless PulseCheck and its owners, employees, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from your use of the service, your content, your monitored systems, your violation of these terms, or your violation of someone else's rights.

12. Changes to These Terms

We may update these terms from time to time. When we make material changes, we will update the date above and provide additional notice when required. Your continued use of PulseCheck after changes become effective means you accept the updated terms.
